CHAPTER XI
EXECUTIVE POWERS RETAINED BY THE CENTRAL GOVERNMENT
48.
(1) The following executive powers shall not be
devolved and shall be vested in the Central Government.
(a) The
defense and the national security of the State, intelligence service, Armed
Forces, any weaponry, explosives, dangerous chemicals, and National Police functions
and duties; proclamation of emergency;
(b) Adoption of national policy on any subject both devolved and not devolved;
(c) Atomic or nuclear energy; national electricity grid;
(d) Internal
affairs; immigration, emigration, Citizenship and Residentship, and
extradition; protocols; registration of persons, death, marriage, and birth;
registration of Non-Government Organizations; incorporations of non-profit
organizations including professional institutions by Charter by President;
issuing of driver’s license and national identity cards;
(e) Foreign
affairs, entering into agreements or treaties with foreign nations,
establishment of diplomatic relations with foreign nations or United Nations
Organization, and diplomatic or trade representation;
(f) War
and Peace;
(g) Posts,
telecommunications, radio frequency spectrum, broadcasting, cyber protection,
and the Internet;
(h) Finance
in relation to national revenue, the Consolidated Fund, monetary policy,
external resources, public debt, foreign loans, currency, coins and legal
tender, Central Bank, banking, insurance, finance companies, lotteries,
customs, stock exchange, foreign exchange, personal tax, tax on goods and
services, CESS and other protection taxes, digital currencies; liquor and
excise; and auditing of public money in all national and local levels. ;
(i) Commercial
Sea ports and airports; aviation, civil aviation, and sea navigation; deep
space;
(j) Foreign
trade and national commerce; tourism;
(k) Railway,
expressways and grade A high ways;
(l) Territorial sea, all rivers and streams; canals and waterways spanning several Localities; all big water tanks (“wewa”); any activity beyond the territorial waters of the sea; international sea;
(m) Minerals
and mines, precious metals, and precious stones;
(n) Census
and statistics;
(o) Higher
education, professional education, research and development, professions
including the School Teacher Service (school teachers should be recognized as a
profession); gene modification;
(p) Places
or objects of national heritage, UNESCO heritage, national museums, national
archives, and archeology;
(q) Protected
Lands, Sky above one hundred meters above ground, State lands, national
gardens, and sanctuaries;
(r) Social
safety net; employee funds, arbitration; salaries, wages, allowances, and
pensions of people;
(s) Standards
and intellectual properties;
(t) Wild life, indigenous fauna and flora;
(u) Public Service; electronic government;
(2) Any executive power not explicitly devolved to Localities shall be deemed to be vested in the Central Government.
(3) The Central Government shall include one or several or all of President, Parliament, Prime Minister, Cabinet Ministers, Vice President, Governors, or deputy ministers.
(4) The Local Government shall mean Local Council along with Provincial Council.
(5) State Assembly, judiciary system, Constitutional
Commission, independent Commissions, and mass communication shall be deemed to
constitute part of both Central Government and Local Government.
49. Both the Central Government and the Local Governments shall work with responsibility, harmony, and in constant consultation with each other when exercising, discharging and performing their powers, duties, responsibilities, and functions in the best interest of the People, the Environment, and Animals.
