CHAPTER I
THE PEOPLE, THE STATE AND SOVEREIGNTY
1. The Republic of Sri Lanka (Ceylon) (LK) is One, Free, Independent, and Sovereign State consisting of the Citizens, the Animals, the Trees, the Nature, the land territories, the territorial sea of the Sea of Sri Lanka, and the Sky of Sri Lanka, as laid down in this Constitution.

The Sovereignty of the Republic lies in the Citizen
and is inalienable.

The Sovereignty shall include all the powers of
government, the Fundamental Rights, the Franchise, and the rich symbiotic Environment;
and shall be exercised and performed in the following manner.
(1) The
Fundamental Rights declared and recognized in this Constitution shall be
exercised and enjoyed by the People individually and collectively; and shall be
respected, secured, and advanced by all State entities without any
restrictions, save in the manner and to extent thereinafter provided.
(2) The
Franchise shall be exercisable at elections of representatives to the
Parliament and to the Local Councils, and at every Referendum by every Citizen
who has attained the age of eighteen years, has the Citizen’s name entered in the
Register of Electors, and is not under a Civic Disability.
(3) The
Legislative Power of the People shall be exercised by the Citizen at a
Referendum, by the State Assembly, and by the Parliament.
(4) The
Executive Power of the People shall be exercised by the President of the
Republic with the Vice President and the Governors of the Provinces, the Prime
Minister with the Cabinet of Ministers and the Deputy Ministers, the Chairmen with
the Vice Local Chairmen, the Chief Ministers of the Provincial Councils, the Constitutional
Council, and the independent Commissions.
(5) The
Judicial Power of the People shall be exercised through the Courts, tribunals,
and institutions created and established by the Constitution, or created and
established by law in the Parliament; except in regard to matters relating to
the privileges, immunities, and powers of Parliament or State Assembly, and of
their Members, wherein the Judicial Power of the People may also be exercised
directly by the State Assembly to the extent provided by law.
(6) The Right to authentic information in relation to governance of the State shall be exercised and enjoyed by the Citizens individually and collectively through, inter alia, free mass media and social media; and shall be respected, secured, and advanced by all State entities.

(1) The territory of the State shall consist of the
Protected Land of Sri Lanka (hereinafter known as the “Green Province (GP)”) which
shall not be inhabited by humans, and five
Provinces which may be inhabited by humans, the names of which are set out as:
(a) Western
Province (WP);
(b) Southern
Province (SP);
(c) Eastern
Province (EP);
(d) Northern
Province (NP); and
(e) Central
Province (CP);
Provided that each Province shall be subdivided into eighty Localities whose names are set out in the First Schedule, in accordance with Article 293;
Further provided that one of such Localities shall be Sri Jayawardenepura (SJ) which shall be the Capital of Sri Lanka.
(2) The territorial waters and the
Exclusive Economic Zone of Sri Lanka shall be known as the “Sea of Sri Lanka”.
(3) The airspace of Sri Lanka over the territorial land and the territorial sea
shall be known as the “Sky of Sri Lanka”.
6.
The National Anthem of the Republic of Sri Lanka
shall be “Sri Lankaa Maathaa”, the words and music of which are set out
in the Third Schedule.
7. The Fourth of February shall be the National Day of the Republic of Sri Lanka.
